  1. Die Klage wird abgewiesen.

  2. Die Kosten des Rechtsstreits hat die Klägerin zu tragen.

  3. Das Urteil ist vorläufig vollstreckbar.

Der Klägerin wird nachgelassen, die Zwangsvollstreckung gegen Sicherheitsleistung oder Hinterlegung in Höhe von 110 % des beizutreibenden Betrages abzuwenden, sofern nicht die Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet.

  1. Die Berufung wird zugelassen.
