für Recht erkannt:

Der Beklagte wird verurteilt, an den Kläger 462,51 € nebst Zinsen in Höhe

von 5 Prozentpunkten über dem Basiszinssatz seit dem 12.02.2003 zu

zahlen. Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden dem Kläger zu 39 % und dem

Beklagten zu 61 % auferlegt.

Das Urteil ist vorläufig vollstreckbar.
