für R e c h t erkannt:
Die Klage wird abgewiesen.
Die Kosten des Rechtsstreits trägt der Kläger.
Das Urteil ist vorläufig vollstreckbar.
Der Kläger kann die Zwangsvollstreckung der Beklagten durch Sicher-heitsleistung in Höhe von 20 % der zu vollstreckenden Kosten abwen-den, wenn diese nicht in gleicher Höhe Sicherheit leistet.
Die Sicherheitsleistung kann auch durch die selbstschuldnerische Bürgschaft eines im Inland als Steuer- und Zollbürgen anerkannten Kreditinstituts erbracht werden.
