hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 9. Mai 1997

durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger

477,94 DM nebst 4 % Zinsen seit dem 7. Februar 1997

zu zahlen.

Im übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits tragen der Kläger

65 % und die Beklagte 35 %.

Das Urteil ist vorläufig vollstreckbar.

Von der Darstellung des Tatbestandes wird gem. § 313 a

ZPO abgesehen.
