durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Es wird festgestellt, dass die Abtretungserklärung vom

  1. Oktober 1990 zur Sicherung des Kredits vom 22. Oktober

1990 seit Juni 1993 insoweit unwirksam ist, als sie Beträge

unterhalb der pfändungsfreien Grenze des § 850 f ZPO betrifft.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagte kann die Vollstreckung durch Sicherheitsleistung von

500,00 DM abwenden, wenn nicht zuvor der Kläger Sicherheit in

gleicher Höhe leistet.
