Die Beklagte wird verurteilt, an den Kläger 1.002,90 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszins seit dem 31.10.2009 zu zahlen.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar. Die Beklagte kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung in gleicher Höhe Sicherheit leistet.
