Tenor

Die Beklagte wird verurteilt, an den Kläger 802,20 EUR nebst 4 % Zinsen seit dem 17.06.1999 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits trägt der Kläger 55 % und die Beklagte 45 %.

Das Urteil ist vorläufig vollstreckbar. Die Parteien können die Vollstreckung durch Sicherheitsleistung von jeweils 120 % des beizutreibenden Betrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
