In this first-instance civil case, the Gronau District Court ordered the defendant to pay the plaintiff €43.50, together with interest at five percentage points above the base rate from 15 September 2004. Tenor

Die Beklagte wird verurteilt, an den Kläger 43,50 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 15.09.2004 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger zu 3/4, der Beklagte zu 1/4.

Das Urteil ist vorläufig vollstreckbar.

Auf die Darstellung eines Tatbestandes wird gemäß § 313 a Abs. 1 ZPO verzichtet.
