Tenor

  1. Der Beklagte wird verurteilt, an den Kläger 2.500,00 Euro nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 06.03.2003 zu zahlen, Zug um Zug gegen Rückgabe des Wallach´s T, Lebensnummer ###### (Mikrochip ###########), Rappe mit großem unregelmäßigen Stern und einem Oberlippenfleck.

  2. Es wird festgestellt, dass sich der Beklagte mit der Rücknahme des Wallach´s T in Annahmeverzug befindet.

  3. Der Beklagte wird verurteilt, an den Kläger weitere 545,00 Euro zu zahlen.

  4. Der Beklagte trägt die Kosten des Rechtsstreits.

  5. Das Urteil ist gegen Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages vorläufig vollstreckbar.
