Résumé Omnilex

The applicant sought advisory legal aid for an asylum-related matter and challenged the registrar’s refusal. He had been advised in Bochum on 20 June 2005, before being assigned to U. the following day and arriving there on 23 June. The Bochum District Court held that local jurisdiction arose where the need for advisory legal aid first occurred, when the advice was given in Bochum. A later establishment of residence elsewhere did not change that jurisdiction. The court granted the reminder, set aside the refusal, and granted advisory legal aid. It ordered no reimbursement of out-of-court expenses.

Regeste Omnilex

§ 6(2) BerHG; local jurisdiction for advisory legal aid is determined by the place where the need for such aid arises. If an applicant has not yet established a domestic residence when the need for legal advice occurs, the court at the place where the advice is provided is locally competent. A subsequent establishment of residence in another locality does not retroactively alter jurisdiction already established. The relevant point in time is when the need for advisory legal aid arises, not a later hearing or the date on which the applicant is assigned to a place of residence.

Entscheidungsdatum: 2007-12-07

Aktenzeichen: 52 II 5608/06

ECLI: ECLI:DE:AGBO:2007:1207.52II5608.06.00

Dokumenttyp: Beschluss

Spruchkörper: 52. Abteilung des Amtsgerichts

Normen: §§ 11, 24 a RpflG, § 6 Abs. 2 BerHG

Tenor

Bochum District Court had local jurisdiction because the need for advisory legal aid arose when the applicant was advised in Bochum, before he established a residence elsewhere.

The applicant had no domestic residence when advised on 20 June 2005. His residence in U. could have begun no earlier than his arrival on 23 June. Jurisdiction established when the need for advice arose was not altered by a later change of residence.
