The Bonn District Court directed bailiff T, in enforcement file DR II 1124/13, to obtain information from the pension insurance institutions, the Federal Central Tax Office, and the Federal Motor Transport Authority in accordance with the creditor’s instruction of 23 October 2013. The debtor had already provided an asset disclosure in a different proceeding at the request of another creditor. The court held that the creditor seeking third-party information did not need to initiate a separate proceeding for an asset disclosure; disclosure made in the other proceeding was sufficient.
§ 802 Abs. I ZPO; third-party information in enforcement proceedings. Obtaining information from third parties is not conditional on the creditor having initiated the proceeding for the debtor’s asset disclosure. It is sufficient that the debtor has provided an asset disclosure in another proceeding at the request of a different creditor. The provision therefore allows a creditor to rely on an existing disclosure made in separate enforcement proceedings when seeking third-party information.

Die Einholung von Drittauskünften ist nicht davon abhängig, dass der Gläubiger selbst ein Verfahren zur Abgabe der Vermögensauskunft einleitet.
Es ist ausreichend, dass eine Vermögensauskunft seitens des Schuldner in einem anderen Verfahren auf Betreiben eines Drittgläubigers erteilt worden ist
wird der Obergerichtsvollzieher T im Verfahren DR II 1124/13 angewiesen, gemäß Gläubigerauftrag vom 23.10.2013 die Drittauskünfte bei den Trägern der Rentenversicherung, dem Bundeszentralamt für Steuern sowie dem Kraftfahrbundesamt einzuholen.
