The plaintiff sought an injunction against the defendant’s delivery of the “Einkaufaktuell” advertising circular. The Bonn District Court dismissed the action and ordered the plaintiff to bear the costs. Kann ein Hinweisaufkleber am Briefkasten angebracht werden, dass eine bestimmte Werbewurfsendung nicht gewünscht ist, kann eine Persönlichkeitsrechtsverletzung durch unerwünschte Werbung (hier: "Einkaufaktuell") bereits hierdurch vermieden werden.
Die Geltendmachung eines Unterlassungsanspruchs ist damit unzulässig.
Die Klage wird abgewiesen.
Die Kosten des Rechtsstreits trägt der Kläger.
Das Urteil ist vorläufig vollstreckbar.
Der Kläger darf die Vollstreckung durch die Beklagte durch Sicherheitsleistung in Höhe von 110 % des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht vor der Vollstreckung die Beklagte Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
