Résumé Omnilex

The person concerned challenged a fine notice issued by the City of Bonn on 23 April 2012. Bonn District Court rejected the objection and ordered the person concerned to bear the proceedings’ costs and their own necessary expenses. It held that a person against whom a fine is imposed generally bears the costs under the corresponding application of § 465(1), first sentence, StPO, together with §§ 105(1) and 46(1) OWiG. The fact that there was no opportunity to pay a warning fine and thereby avoid additional costs does not change that allocation. The authority need not investigate why the warning fine was unpaid before issuing the fine notice.

Regeste Omnilex

§ 465 Abs. 1 Satz 1 StPO in Verbindung mit §§ 105 Abs. 1, 46 Abs. 1 OWiG; Kostenfolge bei Festsetzung einer Geldbuße. A person against whom a fine is imposed generally bears the costs of the fine proceedings. This allocation is not altered merely because the person had no opportunity to pay a warning fine and thereby prevent issuance of the fine notice and the associated additional costs. The administrative authority may issue a fine notice without first examining why the warning fine was not paid: requiring such an inquiry would be inconsistent with the warning procedure’s purpose of achieving a swift and straightforward resolution.

The objection was rejected; the person concerned must bear the costs of the proceedings and their own necessary expenses.

Under the corresponding application of § 465(1), first sentence, StPO, with §§ 105(1) and 46(1) OWiG, a person against whom a fine is imposed generally bears the costs. Lack of an opportunity to pay a warning fine does not alter that result; the authority need not investigate why it was unpaid before issuing a fine notice.
