The plaintiff challenged a resolution adopted at the owners’ meeting on 17 May 2011 approving the 2010 annual accounts. Bonn Local Court declared the resolution invalid insofar as it concerned the heating-cost statement. The defendants were ordered to bear the costs of the proceedings. The judgment was declared provisionally enforceable upon provision of security equal to 110% of the amount to be enforced.

Tenor

Der Beschluss der Wohnungseigentümerversammlung vom 17.05.2011 zu TOP 8), Jahresabrechnung 2010, wird hinsichtlich der Heizkostenabrechnung für ungültig erklärt.

Die Kosten des Rechtsstreits tragen die Beklagten.

Das Urteil ist gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.
