Regeste Omnilex

§ 111(1), first sentence, TKG; duty to collect customer data and standard of care: The provision requires telecommunications providers to obtain complete and substantively accurate customer information. The duty is not satisfied merely by accepting information supplied by a customer. Collecting and storing customer data through the internet without any verification or authentication does not meet the standard of ordinary commercial care. A negligent breach may therefore constitute an administrative offence punishable under § 149(1) no. 29 TKG; where the responsible party is a legal person or association, a fine may be imposed under § 30(1) OWiG.
