Tenor
Der Vollstreckungsbescheid des Amtsgerichts Wedding/ Berlin vom 20.01.2011 (Geschäftsnummer 10-1114398-0-9) wird insoweit aufrecht erhalten, als der Beklagte verurteilt worden ist, an die Klägerin 1.259,00 € nebst Zinsen in Höhe von 13 % seit dem 28.10.2010 sowie weitere 156,50 € zu zahlen. Im Übrigen wird der Vollstreckungsbescheid aufgehoben und die Klage abgewiesen.
Die Widerklage wird abgewiesen.
Die Kosten des Rechtstreits trägt der Beklagte.
Das Urteil ist gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar. Die Zwangsvollstreckung aus dem Vollstreckungsbescheid darf nur gegen Leistung dieser Sicherheit fortgesetzt werden.
