Die Beklagte wird verurteilt, an die Klägerin 402,33 EUR nebst 5 Prozentpunkte Zinsen über dem Basiszins seit dem 28.11.2006 zu zahlen.

Von den Kosten des Rechtsstreits tragen die Beklagte 31 % und die Klägerin 69 %.

Das Urteil ist vorläufig vollstreckbar.

Die Parteien dürfen die Vollstreckung durch Sicherheitsleistung in Höhe von 105 % des zu vollstreckenden Betrages abwenden, wenn nicht die jeweilige Gegnerin vor der Vollstreckung Sicherheit in gleicher Höhe leistet
