Der Beklagte wird verurteilt an die Klägerin 52,00 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz hieraus seit dem 06.12.2005 sowie außergerichtliche Rechtsanwaltskosten in Höhe von 26,39 € an die Klägerin zu zahlen.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist vorläufig vollstreckbar.

Von der Darstellung eines Tatbestandes wird gemäß § 313 a I ZPO abgesehen.
