Résumé Omnilex

The Kerpen District Court declared invalid the condominium owners' resolution of 30 March 2004 concerning balcony renovation and cost exemption. Applying the community rules on exclusive-use building parts, the court held that owners with balconies bear the related renovation costs. It also declared that costs for removing and reinstalling awnings necessitated by the work are payable only by owners with balconies, not by other owners. The respondents were ordered to bear one twelfth of the procedural costs, with no award of extrajudicial costs.

Where the community rules or declaration of division allocate maintenance and repair of facilities or building parts designated for an owner's exclusive use to that owner, the allocation encompasses all costs attributable to their renovation. For balconies, the costs of balcony renovation are therefore borne by the owners who have balconies. This also includes the costs of removing and reinstalling awnings where that work is required because of balcony renovation; owners without balconies are not liable for those costs. The result differs from the contrary approach in OLG Düsseldorf, order of 12 January 1998, 3 Wx 546/97.

The resolution was declared invalid.

Under the community rules, facilities and building parts designated for an owner's exclusive use, including balconies, must be maintained and repaired at that owner's expense; balcony renovation costs therefore fall on owners with balconies.

Those costs must be borne only by the condominium owners who have balconies.

The costs arise from work on balconies designated for the exclusive use of the owners who have them, and the community rules allocate related maintenance and repair costs to those owners.

The respondents must bear one twelfth of the procedural costs; no reimbursement of the participants' extrajudicial costs is ordered.
