The applicant asked the District Court of Brühl to impose an enforcement fine on the respondent for an alleged breach of the parties’ contact agreement, approved in proceedings 32 F 350/07 on 4 November 2010. The court rejected the request. It nevertheless warned the parties under § 89(2) FamFG that breaches of the contact arrangements may be sanctioned by an enforcement fine or, if that cannot be collected, detention; detention may be ordered directly if a fine is unlikely to succeed. The court waived court costs and ordered no reimbursement of extrajudicial costs.

Tenor

Der Antrag des Antragstellers auf Festsetzung eines Ordnungsgeldes gegen die Antragsgegnerin wird abgewiesen.

Die Beteiligten werden unter Billigung ihrer Vereinbarung vom 4.11.2010 im Verfahren 32 F 350/07 (§ 156 Abs. 2 FamFG) gemäß § 89 Abs. 2 FamFG darauf hingewiesen, dass jede Zuwiderhandlung gegen die getroffenen Vereinbarungen zur Regelung des Umgangs durch Festsetzung eines Ordnungsgeldes oder, wenn dieses nicht beigetrieben werden kann, Ordnungshaft geahndet werden kann. Falls die Anordnung von Ordnungsgeld keinen Erfolg verspricht, kann sogleich Ordnungshaft angeordnet werden.

Von der Erhebung von Kosten für dieses Verfahren wird abgesehen.

Außergerichtliche Kosten der Beteiligten sind nicht zu erstatten
