In this first-instance civil judgment, the Brühl District Court partially granted the plaintiff’s payment claim. Tenor

Die Beklagte wird verurteilt, an die Klägerin 1.316,09 € nebst Zinsen in

Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 30.03.2009

zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Beklagte zu 94% und die Klägerin zu 6%.

Das Urteil ist vorläufig vollstreckbar, für die Klägerin jedoch nur gegen Sicherheitsleistung in Höhe von 110% des zu vollstreckenden Betrages. Die Klägerin darf die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 110% des gegen sie vollstreckbaren Betrages abwenden, wenn die Beklagte nicht vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
