Tenor

Der Beklagte wird verurteilt, an den Kläger, 5,35 Euro nebst Zinsen in Höhe von 5 % über dem Basiszins seit dem 21. Juni 2007 zu zahlen; im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden dem Beklagten auferlegt.

Das Urteil ist vorläufig vollstreckbar. Die Parteien dürfen die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
