The Bielefeld District Court declared that the defendant must pay the plaintiff up to €5,000 toward a possible supplementary compulsory-share claim relating to M. T., who died on 4 July 2016. Liability applies only to the extent that M. T.’s sole heir, N. T., is not obliged to satisfy the claim and no other donees are liable ahead of, or equally with, the defendant. The defendant was ordered to bear the costs of the proceedings. The judgment is provisionally enforceable as to costs, subject to the stated security arrangements.
Under § 2329 Abs. 3 BGB, a donee’s obligation to satisfy a supplementary compulsory-share claim is subsidiary to the liability of the heir and is subject to the statutory order governing liability among donees. A declaration of liability against a donee may therefore be framed conditionally: liability arises only insofar as the heir is not required to satisfy the claim and no other donee is liable with priority or equal rank. The decision supplies no further reasoning on the interpretation of these rules.

Es wird festgestellt, dass der Beklagte verpflichtet ist, an die Klägerin einen Betrag in Höhe von bis zu 5.000 € zu zahlen,
soweit die Alleinerbin des am 04.07.2016 verstorbenen Erblassers M. T., zuletzt wohnhaft in Bielefeld, nämlich Frau N. T., gegenüber der Klägerin zu einer Befriedigung eines etwaigen Anspruchs auf Ergänzung des Pflichtteils nicht verpflichtet ist und
soweit keine weiteren Beschenkten iSd. § 2329 Abs. 3 BGB vorrangig oder anteilig gleichrangig verpflichtet sind.
Die Kosten des Rechtsstreits trägt der Beklagte.
Das Urteil ist wegen der Kosten vorläufig vollstreckbar. Dem Beklagten wird nachgelassen, die Vollstreckung abzuwenden durch Sicherheitsleistung iHv. 120 % des aufgrund des Urteils vollstreckbaren Betrages, wenn nicht die Klägerin vor der Vollstreckung Sicherheit iHv. 120 % des jeweils zu vollstreckenden Betrages leistet.
Der Streitwert wird auf bis zu 2.750 € festgesetzt.
