In this first-instance civil judgment, the Bielefeld District Court partially granted the plaintiff's claim against the defendant. It ordered payment of DM 1,000 plus 4% interest from 15 February 1991 and rejected the claim to the extent it exceeded that amount. Litigation costs were allocated four-fifths to the plaintiff and one-fifth to the defendant. The judgment was declared provisionally enforceable, subject to security provisions allowing either party to avert enforcement by furnishing security in the specified amount.

Tenor

Die Beklagte wird verurteilt, unter Abweisung im Übrigen, an den Kläger 1.000,00 DM (eintausend Deutsche Mark) nebst 4 % Zinsen seit dem 15.02.1991 zu zahlen.

Die Kosten des Rechtsstreits tragen zu 4/5 der Kläger und zu 1/5 die Beklagte.

Das Urteil ist vorläufig vollstreckbar.

Der Kläger darf die Vollstreckung gegen Sicherheitsleistung in Höhe von 600,00 DM abwenden, wenn nicht die Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet.

Die Beklagte darf die Vollstreckung gegen Sicherheitsleistung in Höhe von 1.300,00 DM abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
