Tenor

Es wird festgestellt, dass das zwischen den Parteien bestehende Vertragsverhältnis aus dem Bausparvertrag Nr. XXXXXX XX vom 04.09.2006 durch die Kündigung der Beklagten vom 26.09.2016 nicht beendet worden ist.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Die Beklagte kann die Vollstreckung der Kläger abwenden durch Sicherheitsleistung in Höhe von 120 % des aufgrund des Urteils vollstreckbaren Betrages, wenn nicht die Kläger vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leisten.
