Tenor
Der Beklagte wird verurteilt, es zu unterlassen, den Bereich der Straße „B“, der als Stichweg ausgestaltet zum Grundstück B xx in I-Stadt führt, mittels einer Videoüberwachungskamera zu überwachen und mit der Kamera Bilder vom Kläger ohne dessen Zustimmung aufzunehmen sowie einen einer Videokamera ähnlich sehenden Gegenstand auf den vorbezeichneten Bereich der Straße B in I-Stadt zu richten.
Dem Beklagten wird angedroht, dass für jeden Fall der Zuwiderhandlung gegen die in Ziffer 1) ausgesprochene Verpflichtung ein Ordnungsgeld bis zu 250.000,00 € und für den Fall, dass dieses nicht beigetrieben werden kann, Ordnungshaft bis zu 6 Monaten festgesetzt werden kann.
Der Beklagte wird verurteilt, an den Kläger außergerichtliche Rechtsanwaltskosten in Höhe von 334,75 € nebst 5 Prozentpunkten Zinsen über dem jeweiligen Basiszinssatz seit dem 12.01.2016 zu zahlen.
Die Kosten des Rechtsstreits trägt der Beklagte.
Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 3.000,00 €.
