In dem Rechtsstreit
hat das Amtsgericht Aachen
im schriftlichen Verfahren in welchem Schriftsätze
eingereicht werden konnten bis 26.05.2011
für Recht erkannt:
Die Beklagte wird verurteilt, an die Klägerin weitere 651,08 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 11.06.2010 sowie außergerichtliche Rechtsverfolgungskosten in Höhe von 316,18 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 11.06.2010 zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits werden zu 47 % der Klägerin und zu 53 % der Beklagten auferlegt.
Das Urteil ist vorläufig vollstreckbar.
Beiden Parteien bleibt nachgelassen, die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrags abzuwenden, sofern nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
