Tenor

  1. Der Beklagte wird verurteilt, an die Klägerin 1.818,72 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 1. Juni 2005 zu zah-len.

  2. Im übrigen wird die Klage abgewiesen

  3. Von den Kosten des Rechtsstreits tragen 32 % die Klägerin und 68 % der Beklagte.

  4. Das Urteil ist vorläufig vollstreckbar, für die Klägerin jedoch nur gegen 110 % Sicherheit in Höhe des zu vollstreckenden Betrags.
