Tenor
Die Beklagte wird verurteilt, den Kläger von der Zahlungsverpflichtung gegenüber der Mietwagenrechnung der Firma B GmbH, T000-Str. , ####1 B2, Rechnungs-Nummer ####2, vom 28.12.2004 in Höhe von 698,33 € freizustellen.
Im übrigen wird die Klage abgewiesen.
Von den Kosten des Rechtsstreits haben der Kläger 9 % und die Beklag-te 91 % zu tragen. Die Kosten der Nebenintervenientin haben zu 91 % die Beklagten zu tragen. Im übrigen trägt die Nebenintervenientin ihre Kosten selbst.
Das Urteil ist vorläufig vollstreckbar.
Die Beklagte kann die Zwangsvollstreckung des Klägers durch Sicher-heitsleistung in Höhe von 120 % des jeweils zu vollstreckenden Betrages abwenden, wenn nicht dieser zuvor in derselben Höhe Sicherheit leistet.
