Tenor

Die Beklagte wird verurteilt, an den Kläger 528,30 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 16. August 2003 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits tragen 58 % der Kläger und 42 % die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Beide Parteien dürfen dies gegen

110 % Sicherheit abwenden, wenn nicht die Gegenpartei zuvor Sicherheit in gleicher Höhe leistet.
