In this first-instance civil judgment, the Local Court of Aachen dismissed the plaintiff’s claim and allowed the defendant’s counterclaim. Tenor

  1. Die Klage wird abgewiesen.

  2. Auf die Widerklage wird der Kläger verurteilt, an die Beklagte 421,00 DM nebst 4 % Zinsen ab dem 19.08.1998 zu zahlen.

  3. Der Kläger trägt die Kosten des Rechtsstreits.

  4. Das Urteil ist vorläufig vollstreckbar. Dem Kläger bleibt nachgelassen, die Vollstreckung durch die Beklagte gegen Sicherheitsleistung in Höhe von 120 % des zu vollstreckenden Betrages abzu-wenden, wenn nicht die Beklagte vor der Vollstre-ckung Sicherheit in gleicher Höhe leistet.
