The court held that, in petty-offence criminal proceedings, the petty-offence authority itself must decide on the appointment of official defence counsel because it acts as the procedural authority under federal criminal procedure law. The fact that the legislation did not expressly envisage official defence in this context is irrelevant; an apodictic cantonal rule assigning the matter elsewhere is inapplicable before the petty-offence authority.

Aus den Erwägungen: "[...] 16. Zuständig zur Bestellung eines amtlichen Verteidigers ist die Verfahrenslei- tung (Art. 132 Abs. 1 StPO). Die Verfahrensleitung obliegt im Übertretungsstraf- verfahren der Übertretungsstrafbehörde (Art. 61 lit. b StPO). Sie hat demnach auch über die amtliche Verteidigung zu befinden. Daran ändert nichts, wenn so- wohl der eidgenössische wie der kantonale Gesetzgeber offenbar nicht an die Bestellung einer amtlichen Verteidigung in diesem Rahmen gedacht haben. In der Strafprozessordnung findet sich keine Regelung für die Entschädigung des amtli- chen Verteidigers durch die Übertretungsstrafbehörde (Art. 135 Abs. 2 StPO; die- se ergibt sich immerhin indirekt über die Bestimmung von Art. 357 Abs. 1 StPO; so auch BSK StPO-Ruckstuhl, Art. 135 N 11), und im kantonalen GOG heisst es in § 155 apodiktisch im Vorverfahren gegen Erwachsene werde die amtliche Ver- teidigung von der Oberstaatsanwaltschaft bestellt. Den Materialien lässt sich nicht entnehmen, dass sich der kantonale Gesetzgeber mit der Bestellung eines amtli- chen Verteidigers im Übertretungsstrafverfahren befasst hat. Man hat diese Mög- lichkeit ganz offensichtlich übersehen, denn die Kantone sind zwar frei eine Über- tretungsstrafbehörde einzusetzen (Art. 17 StPO), setzen sie diese ein, können sie jedoch nur Organisatorisches innerhalb der Behörde im Sinne von Art. 14 StPO regeln, der Behörde aber keine ihr gemäss Bundesrecht zustehenden Kompeten- zen wegnehmen. Trotz des klaren Wortlautes von § 155 GOG findet dieser im Verfahren vor der Übertretungsstrafbehörde keine Anwendung. [...]"
