The Obergericht, I. Zivilkammer, held that the daughters of former spouses were not entitled to request clarification of their parents' divorce judgment under Art. 334 ZPO because they were neither parties, intervening parties, nor successors. As third parties, they also lacked standing to bring an appeal. The court therefore did not enter into the complaint. It additionally noted that the lower court's remedy information was incomplete: while the clarification decision itself is appealable, a granted clarification restarts the time limit for the correct main remedy, which would otherwise have been an appeal.

If clarification is granted, the time limit for the proper main remedy runs anew against the new first-instance decision; the appeal under Art. 334 para. 3 ZPO is directed only against the decision on clarification, not against the substantive remedy that becomes available against the clarified judgment (consid. 5).

Art. 334 ZPO, Legitimation zur Stellung eines Gesuchs um Erläuterung. Ein Gesuch um Erläuterung kann von den Parteien, Nebenparteien oder Rechtsnach- folgern eingereicht werden; nicht jedoch von Dritten. Die Töchter der ehemaligen Scheidungsparteien verlangten vor Vorinstanz die Er- läuterung des Scheidungsurteils. Die Vorinstanz erläuterte das Scheidungsurteil und belehrte das Rechtsmittel der Beschwerde. (aus den Erwägungen des Obergerichts:)

  1. Das Gesuch um Erläuterung kann auch von Nebenparteien oder Rechtsnachfolgerinnen der Parteien eingereicht werden, nicht aber von Dritten (Schwander, DIKE-Komm-ZPO, Art. 334 N 9). Wird in einer Konvention dem Kind ein Mündigenunterhaltsanspruch eingeräumt, handelt es sich um einen Vertrag zu Gunsten Dritter (BSK ZKB I-Breitschmid, Art. 133 N 14). Die Gesuchstellerinnen sind weder Nebenpartei noch Rechtsnachfolgerinnen im Scheidungsverfahren. Demzufolge waren sie nicht dazu legitimiert, ein Gesuch um Erläuterung des Scheidungsurteils ihrer Eltern zu stellen. Ebenso wenig sind sie daher zur Erhe- bung eines Rechtsmittels legitimiert, weshalb auf die Beschwerde nicht einzutre- ten ist. Auch unter der Herrschaft des früheren Prozessrechts hätte es an der Le- gitimation der Gesuchstellerinnen zur Stellung des Gesuchs um Erläuterung bzw. zur Erhebung eines Rechtsmittels gefehlt (s. Hauser/Schweri, GVG, Kommentar zum zürcherischen Gerichtsverfassungsgesetz, Zürich 2002, § 163 N 1). Anzumerken ist, dass die Rechtsmittelbelehrung der Vorinstanz unvollstän- dig war. Zwar ist ein Entscheid über das Erläuterungsbegehren mit Beschwerde anfechtbar (Art. 334 Abs. 3 ZPO). Wird aber das Erläuterungsbegehren gutge- heissen, beginnt die Frist für das zutreffende Hauptrechtsmittel neu zu laufen. Der neue erstinstanzliche Entscheid unterliegt unter den jeweiligen Voraussetzungen demjenigen Rechtsmittel, das gegen den ursprünglichen Entscheid gegeben war
