The Obergericht, II. Zivilkammer, held that the recourse was timely because proof of postal handover on the deadline day could be established by witness testimony. Despite an inconclusive postal stamp on the later-arriving envelope, the attorney and his assistant were found credible. The court further held that the evidentiary proceedings on timeliness were unnecessary and were caused by counsel's failure to send the filing by registered mail, so one quarter of the total costs had to be borne personally by the attorney.

Where the court must conduct evidence-taking solely because counsel chose an unregistered mailing and thereby created avoidable uncertainty as to timeliness, the resulting costs are unnecessary within the meaning of § 66 Abs. 3 ZPO and may be imposed personally on the responsible attorney (consid. 1, 4).

§ 193 GVG, Fristwahrung. Der Beweis rechtzeitiger Postaufgabe kann (auch) durch Zeugen erbracht werden (Erw. 1). § 66 Abs. 3 ZPO, unnötige Kosten. Der Anwalt, der eine fristgebundene Sendung nicht eingeschrieben aufgibt und damit ein Beweisverfahren zur Fristwahrung verursacht, trägt dessen Kosten (Erw. 4). 1.(...) Die Frist [zur Erklärung des Rekurses] lief bis und mit Donnerstag den 2. Februar 2006 (§ 191 GVG), und ein Rekurs musste bis zum Ende dieses Tages der schweizerischen Post übergeben werden (§ 193 GVG). Am Montag 6. Februar 2006 ging beim Obergericht eine nicht eingeschriebene Sendung ein, welche den mit 2. Februar 2006 datierten Rekurs enthält. Die Sendung ist vom Briefzentrum 8000 Zürich mit -3.-2.06-16 gestempelt. Das wäre zu spät. Dem Re- kurs beigelegt war ein Schreiben des Anwaltes, in welchem er erklärte, "Hiermit reiche ich [...] rechtzeitig Rekurs ein", und mit einer Bestätigung eines André S., "dass der vorliegende Rekurs fristgerecht [...] in den Briefkasten am Stauffacher eingeworfen wurde". Die Frage der Fristwahrung ist allerdings eine rechtliche (§ 57 ZPO), die das Gericht aufgrund der tatsächlichen Verhältnisse beantworten muss (§ 54 Abs. 1 ZPO). Die Rekurrentin wurde daher aufgefordert, sich zur ef- fektiven Postaufgabe genauer zu erklären. Ihr Vertreter erklärte darauf, der Brief sei "am zehnten Tag, d.h. am 2. Februar ..." in den Briefkasten eingeworfen wor- den. Angesichts des Stempels von (erst) 16 Uhr am Folgetag war das nicht ohne weiteres glaubhaft. Die Beteiligten (Anwalt und Assistent) wurden daher als Zeu- gen einvernommen. Beide bestätigten, dass die Sendung noch am 2. Februar 2006 in den Briefkasten bei der Tramhaltestelle Stauffacher geworfen wurde. Der Assistent wusste zwar keine Details mehr, erinnerte sich aber daran, dass ihn der Anwalt ausdrücklich auf die Problematik aufmerksam gemacht hatte. Der Anwalt seinerseits erklärte seine bestimmte Erinnerung an den Vorfall plausibel damit, dass er wenige Wochen zuvor schon ein gleiches Problem hatte, damals mit einer Ehesache an der I. Zivilkammer, und dass die Sache sich ihm darum besonders einprägte. Unter diesen Umständen kann zu Gunsten der Rekurrentin davon aus- gegangen werden, dass die Rekursfrist eingehalten ist.

(...) 4.Dass das Gericht ein Beweisverfahren durchführen musste zur Frage, ob der Rekurs rechtzeitig der Post übergeben worden war, hat freilich mit der Be- urteilung der Sache nichts zu tun und verursachte unnötige Kosten im Sinne des § 66 ZPO.
