The Obergericht held that an order dissolving a company and directing liquidation under Art. 731b OR is not a bankruptcy-opening procedure. Accordingly, Art. 36 SchKG does not govern suspensive effect; instead, cantonal procedural law applies, here § 275 ZPO. Because the appellate court had not ordered otherwise, the appellant's request for suspensive effect was moot and was not entered into.

OR 731b Abs. 1 Ziff. 3, Liquidation nach den Vorschriften über den Konkurs. Dieses Verfahren ist nicht das der Konkurseröffnung, daher gilt zur aufschieben- den Wirkung nicht Art. 36 SchKG, sondern § 275 ZPO. (Aus den Erwägungen:) 3.2 Die von der Vorinstanz verfügte Auflösung der Rekurrentin und die An- ordnung ihrer Liquidation nach den Vorschriften des Konkurses erfolgten nicht gestützt auf Art. 171 SchKG, sondern in Anwendung von Art. 731b OR. Die Be- stimmungen des SchKG kommen bloss für die Durchführung der Liquidation zur Anwendung. Das Verfahren bis zum Entscheid über die Liquidation an sich, und auch das allfällige Rechtsmittelverfahren richten sich nach kantonalem Prozess- recht. § 275 Abs. 1 ZPO bestimmt, dass ein Rekurs aufschiebende Wirkung hat, wenn das Obergericht nichts anderes anordnet (was hier nicht der Fall war).
