A mere repetition of first-instance submissions does not satisfy this requirement. A pleading that is unnecessarily lengthy, repeats extensive earlier arguments and thereby substantially impairs readability and the identification of the decisive grounds of appeal is deficient and may be returned for correction under Art. 132 Abs. 2 ZPO. Art. 132 Abs. 2 ZPO, Art. 311 ZPO. Weitschweifigkeit einer Berufungs- begründung

Die Berufungsschrift hat sich vornehmlich mit den Erwägungen der Vorinstanz auseinanderzusetzen und soll nicht die eigenen Ausführungen vor der ersten Instanz wiederholen, sonst ist sie mangelhaft i.S.v. Art. 132 ZPO.

Sachverhalt: In einem umfangreicheren Berufungsverfahren mit hohem Streitwert ergab sich, dass die Berufungsbegründung wegen Weitschweifigkeit zurückzuweisen war.

(Aus den Erwägungen:) " Nach Einsicht in die Berufungsbegründung der Klägerin und Berufungsklägerin vom [...], da für das Berufungsverfahren eine - eingeschränkte - Rügepflicht gilt, was bedeutet, dass sich die Berufungsklägerin mit ihrer Berufung vornehmlich mit den Erwägungen des erstinstanzlichen Urteils auseinander zu setzen hat und nicht einfach ihre eigenen Ausführungen vor der ersten Instanz wiederholen soll, da die Klägerin und Berufungsklägerin in ihrer 108-seitigen Berufungsbegründung auf 57 Seiten ihre vorinstanzlichen Prozesseingaben zitiert, da die Berufungsbegründung sodann in grösserem Ausmass weitere Wiederholungen enthält, da die Berufungsschrift damit unnötig weitschweifig ist, die Übersichtlichkeit für Gericht und Gegenpartei erheblich beeinträchtigt und die Erkennung und Beurteilung der massgeblichen Berufungsrügen unzumutbar aufwendig macht,

weshalb die schriftliche Berufungsbegründung in Anwendung von Art. 132 Abs. 2 ZPO an die Klägerin und Berufungsklägerin zur Verbesserung zurückzuweisen ist mit der Auflage, ihre Rechtsschrift auf rund 50 Seiten zu beschränken, unter Hinweis darauf, dass in der verbesserten Berufungsbegründung keine neuen, in Urk. .. (Anm. Red.: = zu verbessernde Berufungsschrift) nicht bereits vorgebrachten Rügen und Ausführungen enthalten sein dürfen, wird verfügt: 1. Die Berufungsbegründung vom ... wird der Klägerin und Berufungsklägerin zurückgesandt. 2. Der Klägerin und Berufungsklägerin wird eine Nachfrist von 20 Tagen ab Zustellung dieser Verfügung angesetzt, um die Eingabe im Sinne der obigen Erwägungen zu verbessern. Bei Säumnis gilt die Eingabe vom [...] als nicht erfolgt. ..."
