Under Art. 961 Abs. 3 ZGB, the claimant must be set a time limit to bring the substantive action; failure to do so allows deletion of the provisional entry. Costs may be provisionally allocated subject to the outcome of the main proceedings.

Nach Einsicht in das folgende, von der Klägerin sinngemäss am 12. März 2012 gestellte Rechtsbegehren (act. 1): "Es sei das Grundbuchamt C._____ im Sinne von Art. 961 ZGB einst- weilen anzuweisen, zugunsten der Klägerin ein Pfandrecht vorläufig im Grundbuch einzutragen auf Liegenschaft Kat. Nr. ..., GBBl. ..., ... [Adresse], für eine Pfandsumme von CHF 60'609.60 nebst Zins zu 5 % seit 20. Februar 2012."

mit dem Hinweis, dass das Einzelgericht am Handelsgericht des Kantons Zürich das beantragte Bauhandwerkerpfandrecht mit superprovisorischer Verfü- gung vom 12. März 2012 im Umfang von CHF 60'609.60 nebst Zins zu 5 % seit 20. Februar 2012 vorläufig im Grundbuch eintragen liess, und die Beklagte innert der ihr gleichzeitig angesetzten und sodann einmal erstreckten Frist (Prot. S. 3 f.) keine Stellungnahme zum Begehren einreichte, da aufgrund der Eingabe der Klägerin und der eingereichten Unterlagen (act. 1 und 2/1-11) weder ausgeschlossen noch höchst unwahrscheinlich er- scheint, dass die Klägerin für die superprovisorisch eingetragene Pfandsumme auf dem Grundstück der Beklagten im Sinne von Art. 837 Abs. 1 Ziff. 3 ZGB Mate- rial geliefert und Arbeit geleistet hat, und dass sie die Arbeiten am 12. Dezember 2011 abgeschlossen hat, die Viermonatsfrist gemäss Art. 839 Abs. 2 ZGB mit der vorläufigen Eintragung am 12. März 2012 somit gewahrt ist, unter Hinweis auf Art. 961 Abs. 3 ZGB, erkennt das Einzelgericht: 1. Die einstweilige Anweisung an das Grundbuchamt C._____ wird bestätigt als vorläufige Eintragung im Sinne von Art. 961 ZGB mit Wirkung ab vorläu- figer Eintragung gemäss Verfügung vom 12. März 2012 bis zur rechtskräfti- gen Erledigung des gemäss Dispositiv-Ziffer 2 einzuleitenden Prozesses auf der Liegenschaft Kat. Nr. ..., GBBl. ...,

... [Adresse], für eine Pfandsumme von CHF 60'609.60 nebst Zins zu 5 % seit 20. Februar 2012. 2. Der Klägerin wird eine Frist von 60 Tagen ab Zustellung dieses Urteils an- gesetzt, um direkt beim zuständigen Gericht eine Klage auf Feststellung der Forderung als Pfandsumme und definitive Eintragung des Pfandrechts ge- gen die Beklagte anzuheben. Bei Säumnis kann die Beklagte beim Han- delsgericht Zürich den vorläufigen Eintrag (Dispositiv-Ziffer 1) löschen las- sen. 3. Die Entscheidgebühr von CHF 1'600 wird von der Klägerin bezogen. Vorbe- halten bleibt der endgültige Entscheid des Gerichts im ordentlichen Verfah- ren. Für den Fall, dass die Klägerin innert Frist gemäss Dispositiv-Ziffer 2 die Klage nicht anhängig macht, wird ihr die Entscheidgebühr definitiv auferlegt. 4. Die Regelung der Entschädigungsfolgen wird dem Gericht im ordentlichen Verfahren vorbehalten. 5. Schriftliche Mitteilung an die Parteien sowie an das Grundbuchamt C._____, je gegen Empfangsbestätigung. 6. Eine bundesrechtliche Beschwerde gegen diesen Entscheid ist innerhalb von 30 Tagen von der Zustellung an beim Schweizerischen Bundesgericht, 1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde richten sich nach Art. 72 ff. (Beschwerde in Zivilsachen) oder Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 und 90 ff. des Bundesgesetzes über das Bundesgericht (BGG). Die gesetzlichen Fristenstillstände gelten nicht (Art. 46 Abs. 2 BGG).
