BRKE II Nr. 100/1992vom 12. Mai 1992 in BEZ 1992 Nr. 24 5. c) An die Ausnützungsziffer anrechenbar sind gemäss § 255 Abs. 1 PBG (in der am 1. Februar 1992 in Kraft getre tenen revidierten Fassung) alle dem Wohnen, Arbeiten oder sonst dem dauernden Aufenthalt dienenden oder verwendbaren Räu- me in Vollgeschossen, unter Einschluss der dazugehörigen Erschliessungsflächen und Sanitärräume samt inneren Trennwänden. Entsprechende Flächen in Dach- und Untergeschossen sind gemäss § 255 Abs. 2 PBG nur dann anrechenbar, wenn sie je Geschoss dasjenige Mass überschreiten, das sich bei gleichmässiger Aufteilung der ge samten zulässigen Ausnützung auf die zulässige Vollgeschosszahl ergäbe. Diese gegenüber dem früheren Recht wesentlich geänderte Norm ist gemäss der übergangsrechtlichen Festlegung von Art. III Abs. 4 der Gesetzesänderung beim Ausbau bestehender Dach- und Untergeschosse von Gebäuden, die vor der Volks- abstimmung über die Revisionsvorlage (1. September 1991) erstellt worden sind, so- fort anwendbar. Dasselbe gilt ohne Einschränkung hinsichtlich der Nichtanrechnung der Aussenwandquerschnitte. Das streitbetroffene Gebäude wurde im Jahre 1974 erstellt; die Voraussetzun- gen für die sofortige Anwendbarkeit von § 255 PBG sind somit erfüllt. Die massgebl i- che Grundfläche beträgt 983,60 m 2 . Der gemäss Art. 3 BauO höchstzulässigen Aus- nützung von 60% entspricht eine anrechenbare Gesamtgeschossfläche von 590,16 m 2 . Bei 3 zulässigen Vollgeschossen (Art. 3 BauO) ergibt sich pro Vollgeschoss eine anrechenbare Fläche von 196,72 m 2 . In diesem Umfang sind gemäss § 255 Abs. 2 PBG dem Wohnen, Arbeiten oder dauernden Aufenthalt dienende oder verwendbare Räumlichkeiten im Untergeschoss des rekurrentischenGebäudes nicht anrechenbar. Das genannte Mass wird von der 1-Zimmer-Wohnung im Untergeschoss selbst dann bei weitem nicht erreicht, wenn den eigentlichen Wohnräumlichkeiten ein Teil der - sämtlichen Wohnungen im rekurrentischen Mehrfamilienhaus dienenden- Er- schliessungsflächen im Untergeschoss zugerechnet wird. Ist die gegenwärtig zu Ar- beits zwecken genutzte 1-Zimmer-Wohnung im Untergeschoss nicht anrechenbar, so kommt es neurechtlich nicht zu einer Erhöhung der bisherigen (bewilligten) Ausnüt- zung der Bauparzelle. Dass das Grundstück bisher übernutzt war, ist belanglos. Der Gesetzgeber hat die Nichtanrechenbarkeit der fraglichen Nutzflächen in Unter- bzw. Dachgeschossen bestehender Gebäude nicht daran geknüpft, dass die jeweiligen Bauten hinsichtlich der Ausnützung rechtmässig sind. § 357 PBG ist auf diesen mit der Spezialnorm von § 255 PBG erfassten Sachverhalt nicht anwendbar. Die fragliche 1-Zimmer-Wohnung im Untergeschoss des rekurrentischen Ge- bäudes ist somit einer Bewilligung zugänglich.
