Résumé Omnilex

The decision concerns the planning consequences of the 1991 revision of the Planning and Building Act. The court states that forest setback lines must be fixed for all forest parcels in building zones under § 66 PBG. If such lines are still missing, there is a missing planning measure under § 234 PBG. A building project that would negatively prejudice these still-to-be-established lines cannot be approved.

Regeste Omnilex

§ 66 PBG, § 234 PBG; forest setback lines in building zones: duty to establish, missing planning, and effect on building permits. After the revision of the Planning and Building Act of 1 September 1991, forest setback lines must be fixed for all forest parcels within building zones. If such lines are absent, this constitutes a missing planning measure under § 234 PBG. Building projects that would prejudicially pre-empt the later fixing of these lines are not eligible for approval; the permit authority must refuse authorization until the requisite planning has been completed.
