März 2002 in BEZ 2002 Nr. 39 Zunächst wurde festgehalten, dass Gründe des Vertrauensschutzes der Anord- nung, das Dach mit Ziegeln vorschriftskonform umzudecken, nicht entgegenstehen. Nicht relevant war auch der Umstand, dass die Nachbarn dem Projekt zugestimmt hat- ten, weil eine Eindeckung des Daches mit Eternit statt mit Ziegeln eine geringere Dach- neigung erlaubt und damit eine kleinere Gesamthöhe der Baute erreicht wird. 6. Der Verstoss gegen Art. 10 BZO, wonach für Dächer Ziegel in herkömmlicher Form und Farbe zu verwenden sind, stellt keine untergeordnete Regelabweichung dar. Unbesehen der Frage der Einsehbarkeit steht die strittige Bedachung in einem deutli- chen Gegensatz zum Normziel einer ästhetisch gut und in herkömmlicher Weise gestal- teten Dachlandschaft, an der ein erhebliches öffentliches Interesse besteht. Entscheidend sind im vorliegend zu beurteilenden Fall insbesondere auch die prä- judiziellen Aspekte. Würde hier auf die Einhaltung der fraglichen Norm verzichtet, so müsste die Vorinstanz – wie sie zutreffend ausführt – aus Gründen rechtsgleicher Be- handlung in vergleichbaren Fällen in derselben Weise verfahren und damit das mit Art. 10 BZO verfolgte gestalterische Ziel unterlaufen. Unter analogen Fällen sind nicht – wie die Rekurrentin vermeint – nur reine Stallbauten zu verstehen, sondern (neben Haupt- gebäuden) allgemein Besondere Gebäude (Garagen oder ähnliche Unterstände), bei denen eine Bedachung mit Eternit anstelle von Ziegeln ebenso gut in Betracht fallen könnte. Im übrigen liess sich denn auch anlässlich des Lokaltermins nicht feststellen, dass die Baubehörde in der Kernzone vergleichbare Eternitbedachungen zugelassen hätte. Es ist zwar nicht zu verkennen, dass die Sanierung mit gewissen Umtrieben ver- bunden ist. Dass der finanzielle Aufwand für den Ersatz der bestehenden Eternitbeda- chung durch eine Ziegeldachkonstruktion inkeinem Verhältnis zum anvisierten Zweck stehe, ist jedoch nicht festzustellen. Die Kosten für eine Sanierung des Daches werden auf rund Fr. 20'000.– geschätzt und halten sich damit durchaus im Rahmen. In Fällen, da ein Bauherr Bauvorschriften missachtet und durch rechtswidriges Ver- halten Tatsachen schafft, verbietet es sich, die Wiederherstellung nachträglich von einer Abwägung der Interessen der Bauherrschaft an ihren getroffenen Investitionen einer- seits sowie der öffentlichen und nachbarlichen Interessenandererseits abhängig zu ma- chen. Sonst ergäbe sich die unhaltbare Folge, dass der Grundsatz der Verhältnismäs- sigkeit umso eher verletzt und die Wiederherstellung des rechtmässigen Zustandes um- so erschwerter wäre, je umfangreichere Investitionen in Abweichung von der erteilten Baubewilligung und im Widerspruch zum materiellen Baurecht getätigt worden sind.
