The European Commission of Human Rights held that a complaint against the refusal to consult the land register did not involve a civil right within the meaning of Article 6(1) ECHR. Because the underlying dispute fell outside the material scope of Article 6, the applicant’s additional complaint that the Federal Supreme Court proceedings lacked publicity and fairness was also declared incompatible ratione materiae. The application was therefore rejected as inadmissible under Article 27(2) ECHR.

Art. 6 § 1 CEDH. Droit à un procès équitable. Champ d'application matériel.

Le litige relatif au rejet d'une demande de consultation du registre foncier ne constitue pas une contestation sur un droit de caractère civil.

Art. 6 § 1 EMRK. Anspruch auf ein billiges (faires) Verfahren. Sachlicher Geltungsbereich.

Die Streitigkeit bezüglich die Abweisung eines Gesuchs um Einsicht in das Grundbuch betrifft keinen zivilrechtlichen Anspruch.

  1. Le requérant se plaint encore que la procédure devant le Tribunal fédéral n'ait pas été conforme aux exigences de publicité et d'équité prévues à l'art. 6 § 1 CEDH.

En l'espèce, eu égard à la nature officielle du registre foncier tenu par les autorités étatiques en vue d'assurer la publicité foncière, la Commission est d'avis que la contestation tranchée en dernier lieu par le Tribunal fédéral concernant le rejet de la demande de consultation par le requérant du registre foncier en question ne concernait pas une contestation sur un droit de caractère civil du requérant.

Cette partie de la requête doit dès lors être rejetée comme étant incompatible ratione materiae avec les dispositions de la convention au sens de l'art. 27 § 2 CEDH.
