The Federal Assembly approved Article 21 paragraph 2 of the Neuchâtel Law on the Liability of Public Bodies and Their Agents, which assigned the covered disputes to the Federal Tribunal. The decree also specifies that the Federal Tribunal will decide under the procedure applicable to administrative actions. It further states that the decree is not subject to referendum because it is not of general scope.
Art. 114bis al. 4 Cst.; approval of a cantonal attribution of jurisdiction to the Federal Tribunal; the federal legislature may approve a cantonal provision conferring competence on the Federal Tribunal, and may determine the applicable procedural framework where the attribution so provides. A decree of this nature may be declared non-referendable when it is not of general scope.
Arrêté fédéral concernant l'approbation d'une attribution de compétence au Tribunal federal par le canton de Neuchâtel
du 18 septembre 1990
L'Assemblée fédérale de la Confédération suisse, vu l'article 114bis, 4e alinéa, de la constitution; vu le message du Conseil fédéral du 14 février 19901), arrête:
Article premier
1 L'article 21, 2e alinéa, de la loi du canton de Neuchâtel du 26 juin 1989 sur la responsabilité des collectivités publiques et de leurs agents (loi sur la responsabili- té) est approuvé.
2 Le Tribunal fédéral statue sur les contestations visées au 1er alinéa selon la procédure applicable à l'action de droit administratif.
Art. 2
Le présent arrêté, qui n'est pas de portée générale, n'est pas soumis au référen- dum.
