The Federal Assembly adopted a federal decree approving the convention of 7 November 1988 by which the Swiss Confederation and Energie nucléaire de Kaiseraugst SA agreed to abandon the Kaiseraugst nuclear power plant project. The decree is of general application and is subject to an optional referendum; it enters into force after expiry of the referendum period or, if a referendum is held, after popular approval. The decree further provides that the Federal Council will abrogate it once all obligations under the convention have been fulfilled.
Art. 24quinquies Cst.; federal approval of an agreement abandoning a nuclear power plant project. The Federal Assembly may approve a convention concluded between the Confederation and a private company concerning the abandonment of a planned nuclear installation. A decree of general application may be made subject to an optional referendum and may enter into force after expiry of the referendum period or after popular acceptance. It may also provide for later abrogation by the Federal Council once the contractual obligations have been performed.

L'Assemblée fédérale de la Confédération suisse, vu l'article 24quinquies de la constitution; vu le message du Conseil fédéral du 9 novembre 19881), arrête:
Article premier Approbation de la convention
La convention conclue le 7 novembre 1988 entre la Confédération suisse et Energie nucléaire de Kaiseraugst SA réglant l'abandon du projet de centrale nucléaire est approuvée.
Art. 2 Référendum et entrée en vigueur
1 Le présent arrêté, qui est de portée générale, est sujet au référendum facultatif. 2 Le présent arrêté entre en vigueur le lendemain de l'expiration du délai référendaire ou, le cas échéant, de l'acceptation dudit arrêté en votation popu- laire.
3 Le Conseil fédéral abrogera le présent arrêté lorsque toutes les obligations découlant de la convention auront été remplies.
