The Federal Assembly adopted a federal decree on 3 June 1987 ordering the total revision of the Federal Constitution of 29 May 1874. It instructed the Federal Council to submit a draft new constitution and specified that the draft should update and systematize constitutional law and harmonize its language and normative density. The decree was stated to be non-general in scope and not subject to referendum.
Art. 120 cst.; total revision of the Federal Constitution may be decreed by the Federal Assembly, which may at the same time instruct the Federal Council to prepare and submit a draft of a new constitution. The draft may be framed as an instrument for updating existing written and unwritten constitutional law, rendering it comprehensible, systematizing it, and harmonizing its language and normative density. A federal decree of this kind is not of general application and is not subject to referendum.
Arrêté fédéral sur la révision totale de la constitution fédérale
du 3 juin 1987
L'Assemblée fédérale de la Confédération suisse,
vu le rapport du Conseil fédéral du 6 novembre 19851), arrête:
Article premier
La révision totale de la constitution fédérale du 29 mai 1874 est décrétée (art. 120 cst.).
Art. 2
Le Conseil fédéral soumettra à l'Assemblée fédérale le projet d'une nou- velle constitution.
Art. 3
Le projet mettra à jour le droit constitutionnel actuel, écrit et non écrit, le rendra compréhensible, l'ordonnera systématiquement et en unifiera la langue ainsi que la densité normative.
Art. 4
Le présent arrêté, qui n'est pas de portée générale, n'est pas soumis au référendum.
