K.________ appealed against an investigating judge's order sending him to the police court for simple and serious traffic offences. He argued that his letter of 16 February 2010 had not been answered and that further inquiry was required. The Tribunal d'accusation held that no additional investigation was necessary because the file contained sufficient evidence and the police report was clear. Applying in dubio pro duriore, it found that trial was justified if guilt was plausible or even merely possible. The appeal was dismissed, the referral confirmed, and CHF 330 in costs imposed on the appellant.
Art. 275, 294 let. f CPP; referral to trial at the investigation stage. The appellate court reviews only whether the file discloses sufficient indicia of guilt to justify sending the accused to judgment. Under the principle in dubio pro duriore, referral is required whenever guilt appears plausible or merely possible; the remaining doubts do not benefit the accused at this stage. The investigative authority need not provide an extensive motivation for that assessment (consid. 2). A request for further investigation fails where the appellant does not substantiate that the factual findings are erroneous and the police report is clear. Costs may be charged to the appellant on dismissal (consid. 2).

Art. 275, 294 let. f CPP Vu l'enquête n° PE10.001938-PVU instruite d'office par le Juge d'instruction de l'arrondissement du Nord vaudois contre K., pour violations simple et grave des règles de la circulation, vu l'ordonnance du 8 septembre 2010, par laquelle le magistrat instructeur a renvoyé le prénommé devant le Tribunal de police de l'arrondissement de La Broye et du Nord vaudois comme accusé des infractions précitées, vu le recours exercé en temps utile par K. contre cette décision, vu les pièces du dossier;
Par ces motifs, le Tribunal d'accusation, statuant à huis clos : I. Rejette le recours. II. Confirme l'ordonnance.
