B.________ appealed against the investigating judge’s order sending G.________ to trial only for unauthorized use of a motor vehicle, challenging the implicit dismissal of the property-damage allegation. The cantonal Tribunal d’accusation held that the damage to the motorcycle was caused only negligently, whereas property damage under Art. 144 para. 1 CP requires intent. Since negligent property damage is not punishable, the implicit dismissal was upheld. The appeal was rejected and the appeal costs of CHF 330 were imposed on B.________.
Art. 144 al. 1 CP, art. 12 al. 1 CP; property damage requires intent. Damage caused merely by negligence does not satisfy the subjective element of the offence and is not punishable as property damage. An implicit dismissal of the charge is therefore justified where the file discloses only negligent conduct. Procedurally, a dismissed appeal may result in the costs being charged to the appellant pursuant to the applicable cantonal criminal-procedure rule (consid. 2).
