Whether the opposition against the criminal order was timely and admissible despite direct notification to the accused.
When a party is represented by counsel, the criminal authorities must notify the order to counsel; the direct notification to the accused was ineffective and did not start the opposition period. The opposition was therefore timely.
Under Art. 87(3) CPP, communications are validly served on legal counsel. Because the accused had counsel, only the notification sent to counsel on 12 January 2012 counted; the personal notification on 10 January 2012 was irregular and had no time-limiting effect. The ten-day period expired on 23 January 2012, the day the opposition was filed.
