Whether the appeal against the refusal to amend the allegations and evidence was admissible under Art. 319 lit. b CPC.
The appeal was not admissible because the challenged procedural order was not one for which the CPC provides an appeal, and no irreparable harm was shown.
The refusal to alter the pleadings is an ordinary first-instance procedural order. The CPC does not provide an appeal against such a refusal, and the appellants retained the ability to raise their objections against the final judgment by appeal or complaint. There was therefore no difficult-to-repair prejudice.
