Whether the appeal against the district court judgment was filed within the statutory deadline.
The appeal was manifestly late because the decision had been notified by registered mail, remained uncollected until the end of the postal holding period, and the appeal was lodged only on 11 May 2010.
Under Art. 458 para. 2 CPC, the appeal had to be filed within ten days of notification; under Art. 35 CPC, expiry of the deadline caused forfeiture of the procedural right. The filing date was far beyond the deadline.
