Whether the appeal remained live after the authority annulled the challenged opposition decision and promised a new decision
The appeal had become moot because the challenged decision was withdrawn and replaced by a new decision to be issued on the same subject.
Under Arts. 83 and 99 LPA-VD, the authority may issue a new decision in the course of proceedings, and the appeal court continues only if the appeal does not become moot. Since the respondent annulled the contested decision entirely, there was no longer a live dispute about that decision.
